This article offers a brief examination of the current implementation of Islamic law in several states of Nigeria. It outlines the reasons for establishing shari'a courts, people's responses to them, and areas of probable political compromise (given vehement opposition from predominantly Christian states). Instead of having a single uniform legal system throughout the country, Nigeria will operate a range of legal procedures that will differ from state to state. The economic and political consequences of these differences remain to be seen. (Pol afr/ DÜI)

Cet article analyse brièvement l'application récente de la charia au Nord-Nigeria. Il met en évidence les facteurs qui ont conduit à l'instauration de cours islamiques, les réactions populaires à celles-ci et les possibles compromis politiques avec les États majoritairement chrétiens. Plutôt qu'un système de droit unique le Nigeria sera sans doute contraint de mettre en place des dispositifs juridiques différents d'un État à un autre. Les effets politiques et économiques de cette application différentielle sont encore incertains.

Ancien protectorat britannique, le Nigeria est en proie, depuis deux décennies, à de récurrents et sanglants affontements interconfessionnels opposant notamment musulmans haoussas et chrétiens yorubas, ibos ou membres des groupes ethniques minoritaires du nord du Nigeria. A ces conflits ethno-religieux, se superposent des clivages de type socio-économiques qui expliquent la tendance de ces conflits à dégénérer en pillage de grande ampleur. Depuis une vingtaine d'années, les différents protagonistes n'ont eu de cesse de se radicaliser. Les questions de la charia, de son application et de la demande d'adhésion du Nigeria à l'Organisation de la conférence islamique ont particulièrement cristallisé ces dissensions. Malgré une Constitution laïque dans son essence, douze Etats du nord du Nigeria sur les trente-six que comptent la fédération appliquent présentement le droit pénal musulman. Cette concurrence politique, qui masque une rivalité sociale et économique, risque de porter atteinte à terme à la stabilité du pays.

"Until this century, Northern Nigeria was a major center of textile production and trade.
